Privacy - Terms and Conditions

Please read these terms and conditions carefully as they incorporate the basis upon which reservations are accepted by Rústica Estate Pty Ltd trading at 1087 Caves Rd Quindalup. Making a reservation automatically accepts all the terms and conditions outlined hereunder. Rústica Estate Pty Ltd reserves the right to change and/or modify any of these terms and conditions at any time without notice and such changes will become effective immediately. Please check these terms and conditions periodically for changes. The effective date of these terms and conditions is 24 October 2025.

PRIVATE PARTIES & EVENTS

Under no circumstances are parties, functions or social gatherings permitted on the property or in guest rooms. In the event this clause is breached, the owner reserves the right to evict all guests immediately and payment will be forfeited. If you wish to host a private event for 8-40 people, this service is potentially available and can only be managed and catered for by Rústica Estate Pty Ltd. All catering and event enquiries can be made to stay@rústicaestate.com.au with prior consultation and approval required.

LEAVERS

Please note that we are unable to accept bookings for guests attending or participating in school leavers (Leavers) celebrations.

NOISE

Please be aware that noise complaints are a breach of terms and conditions and may result in forfeiture of your bond and/or termination of your booking.

GUEST COURTESY

For the comfort of all our guests, we ask that noise is kept to a minimum so everyone can enjoy a peaceful and comfortable stay. Non-registered guests are permitted to visit, however they must not stay the night at Rústica Estate without prior consent.

MAXIMUM NUMBER OF GUESTS

The maximum number of guests must not exceed the max occupancy for the specified accommodation.

Old Barn – 6 guests max

Railways Carriage – 4 guests max

CHECK IN AND CHECK OUT

Check-in/arrival time is from 15:00 (3:00PM). We allow guests to arrive earlier if the apartment/room is ready. Check-out/departure time is prior to 10:00 (10:00AM) - late check-out after this time will incur an agreed additional fee. If Rústica Estate Pty Ltd is fully committed on the departure date, late departures or extensions not already confirmed will not be possible.

Our cleaners are assigned to strict rosters around checkout and an overstay will result in a minimum penalty of $70 per hour.

BEDDING REQUESTS

Each guest room is equipped with the bed size advertised: Queen or King.

Old Barn: Configured with two King beds, which can be split into single beds if required. To request a twin room configuration, 24 hours’ notice is required to allow our housekeeping team to prepare the beds.

Railway Carriage: Features a Queen bed, which cannot be split.

Sofa Beds: Both villas feature a Queen-size sofa bed suitable for additional guests.

If you wish to use the sofa bed, please notify us at least 24 hours in advance. Sofa beds incur a fee of $70 per night.

CANCELLATIONS

Cancellations or changes must be advised by 2 PM (14:00), seven (7) days prior to arrival. If a guest fails to arrive by 7 PM (19:00) on the day of check-in without prior notice to Rústica Estate Pty Ltd, the booking will be released, and 100% of the accommodation fee will be charged. Any pre-payments will also be forfeited.

Amendments made before this deadline are fully refundable.

Packages are non-refundable but are fully transferable to alternative available dates.

Peak Periods & Special Events:

Alternative cancellation policies may apply during high-demand periods such as Christmas, New Year, and special events. These policies will be communicated during the reservation process and are available in your booking confirmation upon request.

MINIMUM LENGTH OF STAY

A standard minimum length stay of two nights is applicable to all bookings, however the minimum number of nights may be increased during high demand or special event periods, as determined by Rústica estate Pty Ltd. If youreserve a room over such dates (as per the reservation terms and conditions) you agree to stay for the required minimum nights. Any changes or cancellations (within the cancellation period) are subject to a penalty and may result forfeiting the pre- payment.

BOOKING AND PAYMENT TERMS

Full payment is required at time of booking.

We accept Visa and MasterCard payments securely via Stripe. All transactions are processed in AUD (Australian Dollars).

For high-demand periods and special events, additional terms may apply, including extended cancellation notice periods. These will be clearly communicated at the time of booking.

If payment is not successfully processed, your reservation may be cancelled without notice.

CAR PARKING

On-site parking is available in front of both villas. Please exercise caution when entering or exiting the property, as it is situated on a busy road with a speed limit of 90 km/h.

The following amenities are included in villas:

• Bed linen, duvet and pillows

• Bathroom amenities including; towels, shampoo, conditioner and body wash

• Beach towels

• Fridge/Freezer

• Kettle, toaster and Nespresso machine

• Cooktop and oven

• Microwave

• Hair dryer

• Smart TV’s

• Iron and ironing board can be requested

INTERNET

Wi-Fi is not currently available at the property. 5G Data connection is available.

CREDIT CARD AUTHORISATION

Rústica Estate Pty Ltd accepts Visa & Master Card. We may pre-authorise a credit card for any charges we deem appropriate to incidental charges that may be applicable based on the length of stay and suite type. Please ensure you have sufficient funds to cover additional incidentals for this purpose.

FAILURE TO PAY

In the event a guest fails to pay immediately upon demand any amount owing to Rústica Estate Pty Ltd, pursuant to the reservation and accommodation (including but not limited to any damage and cleaning fees), Rústica Estate Pty Ltd reserves the right to deny access to the guest and ask that they vacate the premises.

TERMINATION OF BOOKING

The owner and/or booking agent reserves the right to terminate the booking at any time. Due to all booking channels not being perfectly paired, there is a small chance that a double booking may occur. In the event this is to occur it is at the owner's discretion which booking request will be approved.

Should you be evicted from the property for breaching the booking conditions or rowdy behaviour, you will forfeit full payment.

GUEST RESPONSIBILITY

Guests are expected to look after and take all reasonable care of the property and all the furnishings and equipment included in the property. It is the responsibility of the guests to ensure that all doors and windows are securely locked and that the property is left in a clean and tidy state at the end of the holiday. Any faults, damages or breakages must be reported to the owner, relevant booking agent or a representative of the booking agent as soon as possible. Guests will be liable for any breakages or damages caused to the property during the guest’s holiday occupation and all costs of repair and/or replacement shall be payable upon demand to the owner or booking agent. In the event the property is not left clean and tidy the guest will be liable for the cost of excess cleaning which will be charged without notice to the security deposit provided at a rate of $70 per hour.

DAMAGE

The guest will be held accountable for any damage to their guest room and common areas and contents during the stay dates. The guest will be liable

for damages caused (including those by third parties visiting the guest) which will result in charging on repair and replacement cost. We reserve the right to process any charges in addition to accommodation to the presented credit card supplied at booking.

EVICTION OF A GUEST

Rústica Estate Pty Ltd may evict a guest or visitors without warning. Guests who are evicted from Rústica Estate Pty Ltd will be blacklisted and we may choose to notify the police or our agents. A guest is subject to such eviction should the following (but not limited to) occur;

• Intoxication and unsavoury behaviour

• Overcrowding - when the number of persons in the guest room exceeds the capacity (see maximum capacity table)

• Physical or verbal assault towards hotel representatives, residents or other guests

• Wilful damage to Rústica Estate Pty Ltd property

• Any incident for which the police need to be called onto the premises

• Any behaviour posing a safety threat to others

• Ignoring advice to reduce excessive noise (music or other noise)

• Smoking within the guest room/inside enclosed communal areas (a cleaning and deodorizing fine will also apply)

FORCE MAJEURE

Guests and hotel representatives of Rústica Estate Pty Ltd are allowed partial impossibility in an agreement, where the performance of the agreement by either party is subject to acts of God, war, terrorism, government regulations, national disaster, strikes, civil disorder or curtailment of transportation facilities beyond the control of the parties making it inadvisable, illegal, or impossible to fulfil some or all of the agreement. Any agreements, contracts, quotes and reservations may be terminated without penalty for any one or more of such reasons by written notice from one party to the other.

LIMIT OF LIABILITY

We do our best to ensure your reservation arrangements are satisfactory, however Rústica Estate Pty Ltd does not accept any liability whatsoever for any injury damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by any events which are beyond our control including, but not limited to, war, civil disturbance, terrorism, fire, floods, acts of God, acts of Government or of any other authorities, accident to or failure of machinery or equipment, maintenance requirements or industrial action.

PET POLICY

No pets are permitted on site at Rústica Estate.

Guide dogs are permitted and must have a medallion on their collar with the registration number and the owner must also carry a laminated pass (with the owner and dog’s name). Guide Dogs are required to be harnessed in public areas. Please advise ahead of time if you will be travelling with a Guide Dog or pet. A pet cleaning fee of $40 is payable on all bookings where a pet is joining you for your stay

RATES

All rates are quoted in AU$ (Australian dollars) and are per room per night and include 10% goods and services tax (GST). Rates within reservations that have a valid confirmation by Rústica Estate Pty Ltd will be honoured. Rates that have bee quoted are not confirmed until a valid confirmation email has been received from Rústica Estate Pty Ltd and therefore subject to change. Rústica Estate Pty Ltd reserves the right to amend rates that have been confirmed at incorrect rates due to human or distribution errors.

RIGHT OF ENTRY

In the event that the Rústica Estate Pty Ltd has a legitimate cause for concern or if the guest has not been seen nor been able to be contacted over a period of time, the guest room may be entered by a hotel representative to ensure the safety and comfort of all guests is in order.

RIGHT TO REFUSE ENTRY

Rústica Estate Pty Ltd reserves the right to refuse a guest entry to the hotel or accommodation for any reason whatsoever including where the guest has engaged in conduct on a previous occasion adverse to the hotel.

SECURITY AND LOSS PREVENTION

Rústica Estate Pty Ltd takes no responsibility for any personal possessions that are lost, stolen or misplaced whilst on the premises.

SMOKING POLICY

All Rústica Estate guest & communal rooms are non-smoking and smoking in the internal suite is not permitted. Fines will apply to

guests who do not adhere to this policy. Smoking is permitted in designated outdoor areas. Please dispose of cigarette ends safely and thoughtfully if you smoke outside.

THIRD PARTY SELLING

Rústica Estate Pty Ltd does not permit resale to a third party or for trade purposes without prior consent and/or written agreement. Rústica Estate Pty Ltd reserves the right to accept or reject any such reservations and charge 100% of the accommodation.

TRAVEL INSURANCE

We highly recommend all our guests to have an appropriate level of travel and holiday cancellation insurance to cater for any unforeseen circumstances.

DECLARATION & AGREEMENT

In completing the booking application, I hereby acknowledge that I am the guest named in the booking application and that I am over the age of 18 years of age and that I have read and understand these booking conditions prior to making payment of the deposit and that all information provided herein is true and correct. I further agree that the stated conditions will apply to my booking in accordance with the booking conditions and i agree to be held responsible for any and all charges due and payable on this booking and any damages that may occur or excess cleaning as required will be charged to me. If insufficient funds are available from the security deposit, i agree to accept responsibility for outstanding payments.

In paying the deposit I acknowledge I have read and accepted the TERMS & CONDITIONS.

PRIVACY POLICY

Rústica Estate is committed to providing you with the best possible customer service experience.  Rústica Estate is bound by the Privacy Act 1988 (Cth), which sets out a number of principles concerning the privacy of individuals.

Collection of your personal information

There are many aspects of the site which can be viewed without providing personal information, however, for access to future Rústica Estate customer support features you are required to submit personally identifiable information. This may include but not limited to a unique username and password, or provide sensitive information in the recovery of your lost password.

Sharing of your personal information

We may occasionally hire other companies to provide services on our behalf, including but not limited to handling customer support enquiries, processing transactions or customer freight shipping. Those companies will be permitted to obtain only the personal information they need to deliver the service.  Rústica Estate takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

Use of your personal information

For each visitor to reach the site, we expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalised content to you while you are at this Site.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will use for these new purposes only, data collected from the time of the policy change forward will adhere to our updated practices.

Changes to this Privacy Policy

Rústica Estate reserves the right to make amendments to this Privacy Policy at any time. If you have objections to the Privacy Policy, you should not access or use the Site.

Accessing your personal information

You have a right to access your personal information, subject to exceptions allowed by law. If you would like to do so, please let us know. You may be required to put your request in writing for security reasons.  Rústica Estate reserves the right to charge a fee for searching for, and providing access to, your information on a per request basis.
